The draft law supplements the Code of Ukraine on Administrative Offenses with a new article

The Cabinet of Ministers registered in the Verkhovna Rada draft law No. 9194 "On amendments to the code of Ukraine on administrative offenses to strengthen liability for violation of legal requirements in the field of registration of emissions and transfer of pollutants and waste."

The document will introduce administrative responsibility for violations in the registration of emissions and the transfer of pollutants and waste, the representative of the government in the Verkhovna Rada, Taras Melnychuk, reports in Telegram.

It is noted that the draft law is aimed at implementing the provisions of the Law of Ukraine "On the national register of emissions and transfer of pollutants".

Melnychuk emphasized that the document proposes to add a new Article 91-7 to the Code of Ukraine on Administrative Offenses and to determine the responsibility of the operator's officials for violating the requirements of the law. Namely:

  • non-submission, untimely submission of the operator's report, submission of inaccurate data in the operator's report;
  • violation of obligations regarding the submission of documents necessary for state registration, its cancellation, as well as making changes to the National Register of Emissions and Transfer of Pollutants;
  • violation of obligations to ensure the quality of data (completeness, consistency and reliability) on emissions and transfers of pollutants and waste provided to the central executive body, which ensures the formation and implementation of state policy in the field of environmental protection;
  • violation of obligations regarding accounting and storage of supporting documentation, description of the permitted methodology used to collect data included in the operator's report.

He noted that the draft law provides that cases of the specified administrative offenses will be considered by judges of district, district in the city, city or city-district courts. The document also specifies that the authorized officials of the central executive body, which implements the state policy on the implementation of state supervision (control) in the field of environmental protection, rational use, reproduction and protection of natural resources, have the right to draw up the protocols specified in the new Article 91 -7 of the Code of Criminal Procedure on Administrative Offenses.

Earlier, EcoPolitic wrote, that, on April 7, the Cabinet of Ministers approved the draft law "On amendments to the code of Ukraine on administrative offenses to strengthen liability for violation of legal requirements in the field of registration of emissions and transfer of pollutants and waste."

As EcoPolitic previously reported, the President of Ukraine, Volodymyr Zelenskyi, signed the European Integration Law "On the national register of emissions and transfer of pollutants", which will become the only state online data system.
