The government approved a number of important bills in the direction of the environment

It is proposed to establish liability for non-disclosure of information subject to mandatory publication

The Cabinet of Ministers of Ukraine at a meeting on Friday, April 7, approved the draft law "On Amendments to the Code of Ukraine on Administrative Offenses to Toughen Responsibility for Violation of Legislative Requirements in the Field of Registration of Emissions and the Transfer of Pollutants and Waste".

This was reported by the representative of the government in the Verkhovna Rada Taras Melnychuk in Telegram.

He said that the document proposes to determine the responsibility of the operator's officials for violating the requirements of the legislation in the field of registration of emissions and transfer of pollutants and wastes, namely:

  • non-submission, untimely submission of the operator's report, submission of false data in the operator's report;
  • violation of the obligation to submit documents required for state registration, cancellation of state registration of facilities that it operates, as well as changes to the National Register of Emissions and Transfer of Pollutants;
  • violation of obligations to ensure the quality of data on emissions and transfers of pollutants and wastes provided to the central executive body, which ensures the formation and implementation of state policy in the field of environmental protection;
  • violation of obligations to record and store supporting documentation, a description of the permitted methodology that was used to collect the data included in the operator's report.

It is also proposed to establish liability for non-disclosure of information, which, in accordance with the Law "On the national pollutant release and transfer registry" is subject to mandatory disclosure.

In addition, the government has made changes to:

  • Decree of the Cabinet of Ministers No. 25 of January 10, 2023 "On the implementation of a pilot project to create favorable conditions for ensuring the efficient consumption of electrical energy by the population" in terms of establishing the possibility of storing international technical assistance in the warehouses of the State Reserve Agency free of charge, in the volumes and conditions agreed by the coordinator of the pilot project;
  • Rules for granting access to the infrastructure of an electric power facility. Simplified procedure for obtaining access to the infrastructure of the electric power industry, as well as early termination of the access agreement, in the event of complete destruction as a result of hostilities of the infrastructure of the electric power facility and/or all technical means and/or electronic communications structures;
  • Resolution of the Cabinet of Ministers of Ukraine "On the provision in 2022 of a state guarantee for the obligations of the joint stock company "National Joint Stock Company" Naftogaz of Ukraine".

Also, the right of the Minister of Finance of Ukraine (after 2022) to sign documents regarding the state guarantee to ensure the fulfillment of debt obligations under the Loan Agreement by NJSC Naftogaz of Ukraine has been extended.
