The North-Western Appellate Economic Court overturned the decision of the first instance and ordered the Kostopil Plywood Plant located in the Rivne region to compensate over 1 million hryvnias.
The enterprise emitted pollutants into the atmosphere from stationary sources without the appropriate permit, reports the State Environmental Inspection (SEI) of the Polissky District on Facebook.
Violations were discovered by eco-inspectors in November 2020 during an unscheduled inspection. However, the company refused to compensate the losses voluntarily.
Eco-inspectors appealed to the Commercial Court of the Rivne region with a claim for compulsory recovery of damages. However, the court refused to satisfy the claims.
"Disagreeing with the decision of the court of first instance, the Inspectorate filed an appeal with the North-Western Appellate Economic Court with a request to cancel the decision of the court of first instance and to adopt a new decision, which fully satisfies the claims of the Inspectorate," the message reads.
The press service of the SEI noted that in the new decision of the court, the subpoena requirements were satisfied in full. In the case of voluntary non-compliance with the court decision, the materials will be handed over to the enforcement service for their enforcement.
"Only in the current year, the courts have passed 17 decisions in favor of the Inspectorate for a total amount of more than 8 million hryvnias," the report emphasized.
