Activists to stop the construction of the Svydovets mega-resort through the Supreme Court

The appellate court did not analyze the arguments and evidence regarding the impact of the resort on protected areas

The defenders of the Svydovetsky massif filed a cassation appeal to the Supreme Court to stop the construction of the ski mega-resort.

They hope that the court will overturn the Eighth Administrative Court of Appeals Decision of 12/15/2022, the Free Svydovets community on Facebook reports.

Eco-activists said that the composition of the court has already been appointed, and in about a month the date of the meeting will be known. The cassation complaint was filed by lawyer Olha Melen-Zabramna on behalf of local residents and MBO "Ecology-Pravo-Lyudyna", which is the third party on the side of the plaintiffs.

It is noted that Melen-Zabramna appealed to the fact that the Eighth Administrative Court of Appeal incorrectly applied Article 12 of the Law "On Regulation of Urban Development".

The message explained that for certain areas of the Carpathians, the territory planning schemes of the Carpathian region, which are urban planning documents of the highest level, should be considered. The document had to be approved before it was decided to allow the resort to be built.

"That is, a detailed plan for the construction of the resort could not be adopted without a planning scheme for the territory of the Ukrainian Carpathians, for example, at the level of three regions. However, the appellate court decided that this was not a significant violation," the authors explained.

The lawyer also emphasized that the Eighth Administrative Court of Appeal in its decision cited the materials of the detailed plan of the territory, which indicate that the resort "Svydovets" will not be located on protected territories and they will not fall into the zone of influence of the complex. However, the court did not analyze the arguments and evidence of the plaintiffs, which confirm completely opposite facts.

"The Court of Appeal turned a blind eye to the violation of the public discussion procedure. Note that no one has seen the detailed plan of the territory, only in the appeal. A year after its approval, he appeared in court," ecoactivists emphasized.

Earlier, EcoPolitic wrote, that the eco-activists have registered a petition to the President of Ukraine Volodymyr Zelenskyi, the Cabinet of Ministers and the Ministry of Environmental Protection and Natural Resources regarding stopping the transformation of the Svydovetsky massif into a ski resort.

As EcoPolitic previously reported, the construction of the Svydovets ski mega-resort in Transcarpathia is planned will violate 4 international environmental treaties, signed by Ukraine, and will destroy dozens of species of Red Book animals and plants.
