They say that this decision is already final

On October 9, the Cassation Administrative Court as part of the Supreme Court satisfied the cassation appeal of Svydovets' defenders, recognized the previous decision of the Eighth Administrative Court as illegal and annulled the decision of the Rakhiv and Tyachiv district state administrations regarding the approval of the detailed territory plan (DTP) of the Svydovets resort.

This was reported by activists of the Free Svydovets community.

The court heard the representatives of the Yasinyansk and Ust-Chornyansk settlement councils and announced the final part of the decision, in which it annulled the decision of the 8AAS and upheld the decision of the court of first instance. Activists said that these two local self-government bodies had previously ignored court hearings on the case.

According to them, this court decision is already final:

"It means that the detailed plan of the territory, according to which Svidovets was allowed to be developed by the Kolomoiskyi mega-resort, is not valid and further actions for development based on the canceled DPT are impossible."

Members of Free Svydovets suggested that the opponents could once again develop a new DPT and submit it for approval. But they noted that this process will be complicated and will last for years.

Activists also promised to analyze and publish the full decision of the Supreme Court on Svidovets, which should appear soon.

In December 2022, eco-activists opposed the planned construction of the Svydovets ski mega-resort in Transcarpathia, as it will violate 4 international environmental treaties signed by Ukraine, and will destroy dozens of species of red-listed animals and plants.

In January 2023, the defenders of the Svydovetsky massif filed a cassation appeal to the Supreme Court to stop the construction of a mega ski resort.

As EcoPolitic previously reported, in the Carpathians the company of the odious oligarch Igor Kolomoisky "Bukovel" plans build 3 megaresorts, namely "Svydovets", "Bystrytsia" and "Turbat" with a size of 1400 hectares.

In June 2023, the Ministry of Environmental Protection and Natural Resources has taken a step to the preservation of Svidovets: approved the request to create the reserve "Free Svidovets" in Zakarpattia, where they planned to build a ski mega-resort.

In December 2023, EcoPolitic reported that in the Carpathians began preparation before the construction of another mega-resort. It was about the start of the strategic environmental assessment (SEA) of the Bystrytsia ski resort project with an area of 1,200 hectares.
