Developers have repeatedly "encroached" on Galerny Island

Deputy of the Kyiv City Council, member of the environmental commission Yuliya Lymar said that the local authorities are not blocking the creation of the natural monument "Orchid Forest" on Galerny Island, but are preparing a comprehensive basis for the bequest.

Part of the "Orchid Forest" is leased, so the creation of a protected object must be agreed with the land user at the creation stage to avoid possible appeals of the decision in court, reports Tvoemisto.tv.

It is noted that eco-activists accused Limar of blocking the creation of a reserve in order to give the plot for development.

She emphasized that part of the Orchid Forest has been leased since 2007. Therefore, in order to create an object of the nature reserve fund, it is necessary to agree with the land user at the stage of creation. However, there was no such approval in the package of documents presented to the environmental commission on March 8. Therefore, the hearing was postponed.

"I suggested to the commission, in order to avoid a legal conflict, to instruct the Department of Ecology and Natural Resources of the KMDA to develop a road map for the creation of PZF facilities in Kyiv. The relevant decision was unanimously adopted by the commission. Such a document should be presented at the next meeting of the commission",  she explained Saddler.

According to her, in Kyiv, decisions on the creation of new protected objects are often contested in courts. Due to procedural violations of legal requirements, the city often loses cases. Therefore, the commission decided to comply with all requirements before creating a reserve.

She emphasized that the author of the draft decision on the creation of the "Forest of Orchids", Ksenia Semenova, agreed with the commission's proposal to comprehensively resolve the issue of the bequest.

Limar added that for 2022 alone, the commission on ecology considered almost 200 projects of decisions regarding PZF objects, and most of them were implemented.

The article emphasized that Galerny Island was repeatedly "encroached" by developers. However, the natural monument that will protect the site from encroachments on the construction of buildings has not yet been created.
