The existence of the permits proposed for cancellation did not affect the conservation of biodiversity

The Ministry of Environmental Protection and Natural Resources of Ukraine (Minpryrody) assured that the new bill No. 7689 "On Amendments to certain legislative acts of Ukraine on simplification of business conditions (Deregulation)" will not weaken the protection of flora and fauna.

The document is intended to cancel ineffective permits in the field of protection and conservation of biodiversity, which exist only on paper and are not used in practice, as well as contradicting the norms of the current legislation, reports Ministry of Natural Resources.

The bill proposes to cancel the permit or certificate for import into Ukraine and export outside the objects of flora and fauna. They will be replaced by a single permit for the import and export of samples of species of wild fauna and flora, a certificate for traveling exhibitions, re-export and introduction from the sea of ​​these samples that are regulated by the Convention on International Trade in Endangered Species of Wild Fauna and Flora, except for sturgeon and produced of them products.

This will bring the norms of one law in line with the norms of another (the Law "On Accession of Ukraine to the convention on international trade in endangered species of wild fauna and flora").

From the Law "On the list of documents of a permissive nature in the field of economic activity" a permit for the production of game animals (license, shooting card) will be excluded.

"After all, the Law of Ukraine "On the permitting system in the sphere of economic activity" regulates the relations that arise between the licensing authorities, administrators and business entities," the press service explained.

According to the press service, this document cannot be subject to this law, because a permit for the extraction of game animals is issued not to business entities, but to individuals. The obligation and requirement to obtain such a permit remains in the Law of Ukraine "On Hunting".

Draft Law No. 7689 abolishes the permit for the right to engage in breeding in semi-free conditions or in captivity of animal species listed in the Red Book of Ukraine in order to eliminate the existing duplication of procedures.

After all, the Ministry of Natural Resources issues a permit for the special use (extraction, collection) of objects of the Red Book of Ukraine by decision of the National Commission for the Red Book of Ukraine – in accordance with the Law of Ukraine "On the Red Book".

"If the bill is adopted, instead of two actually identical permits, the Ministry of Natural Resources will issue only one," the material explained.

There is also administrative responsibility for violation of the requirements for the protection of animal and plant species listed in the Red Book of Ukraine or protected in accordance with international treaties of Ukraine, included in the list of rare species of animals and plants.

In addition, the bill proposes to exclude permission for the resettlement of animals in new habitats, the acclimatization of new species of wild animals for the fauna of Ukraine, as well as the implementation of measures to cross wild animals. After all, from 2001 to this day, not a single enterprise has applied to the ministry to receive it.

However, the Ministry of Natural Resources has already developed a separate draft law that will regulate the provision of administrative services, in particular, the issuance of a permit for the special use of wildlife objects, which is agreed with the executive authorities.

It will establish clear rules for obtaining permits and limiting the removal of animals from the wild and strengthen control.

The Law of Ukraine "On the protection of animals from cruelty" determines that keeping wild animals in captivity without creating appropriate conditions is not allowed. That is, there are no conditions corresponding to the biological, species and individual characteristics of wild animals, which exclude the possibility of keeping them, regardless of whether the owner has a permit or not.

“And here the main thing for us is the very existence of appropriate conditions for animals, and not the owner's permission,” the press service explained. – Today, the issue of conditions for keeping wild animals in captivity and semi-free conditions is regulated by the order of the Ministry of Environmental Protection of Ukraine dated September 30, 2010 No. 429 "On approval of the procedure for keeping and breeding wild animals in captivity or semi-free conditions." Responsibility for violation of such conditions is established by the Code of Ukraine on Administrative Offenses.

The material emphasized that no one applies to the Ministry of Natural Resources for such a permit.

The statistics of the Ministry of Natural Resources showed that the existence of all these permits did not affect the conservation of biodiversity.

For the protection and conservation of biodiversity in 2022, the following has been developed and adopted:

  • Action Plan for the implementation of the Biosafety and Biological Protection Strategy for 2022-2025 (Decree of the Cabinet of Ministers of Ukraine dated July 7, 2022 No. 573-r);
  • The procedure for regulating the number of animals that are not kept by humans, but are in conditions completely or partially created by human activities, and homeless animals, as well as their placement at the relevant enterprises, institutions and organizations or return to the area of ​​​​residence (catch sites) (decree of the Cabinet of Ministers of Ukraine dated June 24, 2022 (No. 720).

Draft resolutions of the Cabinet of Ministers of Ukraine have been developed and are being approved:

  • "Some issues of temporary withdrawal and maintenance of animals";
  • "On approval of the procedure for creation of protective zones for the preservation of biodiversity in forests and the procedure for the creation of protective zones for the preservation of objects of the Red Data Book of Ukraine".
