Those guilty of violating the requirements of the strategic environmental assessment bear personal responsibility

The analysis of the main violations in conducting a strategic environmental assessment (SEA) showed that they are violations of the requirements of the submission procedure.

Also, documents are often submitted incompletely with low-quality graphic materials, reports the Department of Ecology and Natural Resources of the Lviv Regional State Administration on Facebook.

The message emphasized that the requirements of Part 1 of Article 13 of the Law "On Strategic Environmental Assessment" are most often violated. It provides that the customer submits the draft of the state planning document, the SEA report and the notice of publication of these documents on paper and in electronic form. According to the Ministry of Environmental Protection and Natural Resources, the main objection to the SEA is also the violation of this norm.

It is noted that another most common violation during the SEA of urban planning documentation is the submission of project documents for review:

  • not in full;
  • with reduced copies of graphic materials or their black and white copies.

The authors explained that this makes it impossible to process the submitted materials.

In the message, it was emphasized that those who are guilty of violating the requirements of the legislation of Ukraine during the implementation of a strategic environmental assessment bear personal responsibility for the violation of the legislation.

As EcoPolitic previously reported, the Verkhovna Rada of Ukraine approved in the second reading the government draft law No. 5159 "On liability for violation of the procedure for carrying out a strategic environmental assessment." This document improves the strategic environmental assessment (SEA) procedure, increases its transparency, and also introduces responsibility for its violations.
