On July 16, MPs adopted Draft Law No. 11355 "On Integrated Prevention and Control of Industrial Pollution." "256 MPs voted in favor.

This was reported by MP Yaroslav Zheleznyak on Telegram.

The adoption of this law is one of the requirements of the Ukraine Facility Plan. The deadline for its adoption was September.

Draft Law No. 11355 provides for the implementation of an integrated environmental permit and control of industrial pollution based on the application of the best available technologies and management methods (BTM) in accordance with Directive 2010/75/EU of the European Parliament and the Council of November 24, 2010 "On industrial emissions (integrated prevention and pollution control)".

It defines:

  • basic requirements for an integrated environmental permit;
  • a list of activities that require its receipt;
  • issuing procedure;
  • grounds for refusal of extradition;
  • the grounds and procedure for revoking an integrated environmental permit;
  • requirements for the mandatory application of the best available technologies and management methods, monitoring of emissions and control of compliance with the conditions of the integrated environmental permit.

July 3 Ecopolitics reported that the ecocommittee agreed draft law No. 11355 on industrial pollution to the second reading.

We would like to remind you that this draft law became the "heir" of the European integration project of Law No. 6004-d, one of a number of projects under No. 6004, which the lawmakers started working on as far back as 2021.

On June 20, the Verkhovna Rada of Ukraine adopted as a basis the draft law On Integrated Prevention and Control of Industrial Pollution No. 11355. It turned out to be almost identical to the European integration draft law No. 6004-d "On Ensuring the Constitutional Rights of Citizens to a Safe Environment for Life and Health," which MPs lacked only one (!) vote to adopt on June 19.

EcoPolitic has made a number of publications on the law on industrial pollution. From them, we can draw a general conclusion that representatives of business and the environmental community fully recognize the need to adopt this draft law, but expressed a number of comments and reservations regarding the timing of the BAT introduction and the need to take into account the realities of wartime in Ukraine when implementing European environmental standards and requirements.
