Detectives of the Specialized Anticorruption Prosecutor's Office and the National Anticorruption Bureau of Ukraine informed the Deputy Chairman of the KMDA, Petro Olenych, of the suspicion of abuse of office, which led to the construction of 0.6 hectares of Nyvka Park.

According to the investigation, in 2019 the official indicated that the plot for development does not belong to the nature reserve fund, reports the press service of the SAP on Facebook.

It is noted that in November 2019, while serving as director of the Department of Land Resources of the KMDA, the official received a relevant land management project for consideration. The document provided for the exclusion of the eastern part of the park from the lands of the nature reserve fund and its lease to a private company for the construction of a residential and office complex.

The message emphasized that the project was sent for revision. However, the official, without making the necessary changes, submitted it to the Kyiv City Council for consideration a second time, indicating that the plot does not belong to the nature reserve fund.

"Despite the fact that this information was not true, the deputies still made a decision to transfer the land. As a result, the developer received a part of the park with an area of 0.6 hectares, and the community of the capital lost the right to use it as an object of the nature reserve fund, the SAP said. "The pre-trial investigation is ongoing."

It is noted that the actions of the official are qualified by the characteristics of the crime provided for in Part 2 of Art. 28, Part 2 of Art. 364 of the Criminal Code of Ukraine.

The message emphasized that the court annulled the illegal decision of the Kyiv City Council and recognized the lease agreement as invalid. Also, thanks to the intervention of law enforcement agencies, the illegal construction was stopped.

The NABU added that the building caused damage to the community of about 6.4 million hryvnias.

Although the law enforcement officers did not specify the identity of the official, Olenych confirmed in Telegram that the suspicion had been served and emphasized his innocence.

He noted that in these permits and urban planning documentation were issued in 2017-18 before he took office. The project was approved by the relevant authorities.

"I will prove my rightness and innocence in a legal way. And I will also insist on providing and bringing to justice the citizens who misled the law enforcement officers by providing inaccurate information about this case," Olenych wrote, adding that he would cooperate with the law enforcement officers.

Earlier, EcoPolitic wrote, that the police revealed the corruption scheme of an official from the KMDA, who systematically demanded bribes for the issuance of permits for the emission of pollutants into the atmosphere and other permit documents.

As EcoPolitic previously reported, Kyiv residents are demanding to stop the construction of the "Gravity Park" residential complex with 13 high-rise buildings on 18 hectares of forest in the Svyatoshyn district bordering the "Holosiivskyi" national nature park.
