The construction of commercial facilities is prohibited in regional landscape parks

In Kyiv, the Commercial Court ordered the owner to demolish a self-built cafe in the "Partyzanska Slava" park, which is a nature reserve.

The value of the plot of land on the coast of Lake Veliky, which is part of the landscape reserve of local importance "Chervonokhutorski Ozera", is 8.5 million hryvnias, the press service of the Kyiv City Prosecutor's Office reports on Facebook.

The authors emphasized that the cafe was built on a plot of land belonging to nature reserves and water funds.

"Regional landscape parks, as well as landscape sanctuaries, belong to the nature reserve fund of Ukraine, and the current legislation prohibits their use for the placement of commercial establishments, and even more so - for construction," the message emphasized.

Prosecutors of the Specialized Environmental Prosecutor's Office of the Kyiv City Prosecutor's Office and specialists of the State Environmental Inspectorate of the Capital District participated in the trial.

The press service noted that the court recognized the spontaneity of the construction and the illegality of the acquisition of property rights on the territory of the nature reserve fund. He canceled the registration of ownership of the built structure, obliged the defendant to demolish it and return the land plot to the territorial community.

Earlier, EcoPolitic wrote, that the authorities of Kyiv are demanded to abandon the creation of the National Memorial military cemetery in the "Lysa Hora" tract, which is an object of the nature reserve fund and historical and cultural heritage.

As EcoPolitic previously reported, the Supreme Court of Ukraine decided to leave unchanged the decision of the Kyiv Court of Appeal regarding the return of 17 protected areas on Zhukov Island.
