The EcoCommittee supported the introduction of liability for failure of strategic eco-assessment

The bill may run the risk of endless litigation

On Wednesday, July 13, the eco-committee recommended that the Verkhovna Rada adopt draft law No. 5159 "On amendments to certain laws of Ukraine regarding the introduction of liability for violation of the procedure for strategic environmental assessment."

The Committee on Digital Transformation, the Committee on Budget Issues, the Anti-Corruption and European integration committee were provided positive conclusions regarding the draft law, reports Energy under the dome on Telegram.

While preparing for the second reading, the ecocommittee will take into account the proposals and amendments of the Main Scientific and Expert Department.

Experts from "Energy under the dome" also analyzed the draft law.

They believe that granting any natural or legal person the right to appeal in court the decisions, actions or inaction of state authorities or local self-government bodies in the process of carrying out a strategic environmental assessment will lead to the impossibility of adopting state planning documents and will create the risk of endless legal proceedings.

In addition, the project allows for the annulment of the decisions of state authorities and local self-government bodies on the approval of state planning documents for unfounded/groundless disregard of the proposals of public representatives. At the same time, the project does not establish any criteria, which reasons for non-consideration will be considered unjustified or baseless, or according to which principle public proposals must be taken into account.

The article noted that the bill will have a negative impact on the industry.
