The Ministry of Environmental Protection and Natural Resources of Ukraine has published 6 main stages for implementing the conclusions of the BAT for implementation at Ukrainian enterprises.

They were published on the official resources of the Ministry of Environment, in particular in the Telegram channel.

According to the Ministry, 36 reference documents (BREFs) and 21 BAT conclusions (BAT conclusions) are currently in force in the EU. In the EU member states, they are the basis for determining the mandatory requirements for the work of industrial enterprises.

BAT conclusions contain a description of the best available technologies and management methods that should be applied in a particular industry. That is, they outline for enterprises the technologies and types of equipment that must be used to reduce pollution, as well as standards for maximum permissible emissions, requirements for monitoring, resource and energy consumption, measures to eliminate pollution, etc.

Among the 6 steps necessary for the implementation of BAT in Ukraine, the Ministry of Environment named the following:

  1. Translation of the European BAT.
  2. Processing of the translated text by a working group under the Ministry of Environment.
  3. Provision of recommendations of the working group on approval of the conclusions of BAT.
  4. Public discussion of the draft conclusions of BAT, processing of received proposals.
  5. For some reason, this point is similar to the previous one – "Public discussion of the draft conclusions of the BAT, processing of the received proposals."
  6. Approval of BAT conclusions by order of the Ministry of Environment.

The department also outlined the terms of implementation of BAT conclusions in the work of industrial enterprises in Ukraine: they are approved no later than 12 months later from the day of the official promulgation of Law No. 11355 "On Integrated Prevention and Control of Industrial Pollution".

Specialists of the Ministry of Environment emphasized that the conditions of integrated environmental permits, which will replace several existing permits in the future, will be determined according to the conclusions of BAT. At the same time, the ministry noted the terms for starting the application of the conclusions of the best available methods and technologies:

  • for existing installations – not earlier than in 4 years from the date of termination or cancellation of martial law;
  • for new installations – from the date of entry into force of such conclusions.

The department informed that, as of now, 6 working groups under the ministry have already processed 10 reference documents of BAT. The groups working on the preparation of BAT include representatives of authorities, industry, non-governmental environmental organizations and the public.

According to the Ministry of Environment, working groups have already finalized the texts of the translated reference documents on the production of cement, lime and magnesium oxide, non-ferrous metallurgy, cast iron and steel. They must be approved no later than 12 months after the official publication of the basic act – the law "On Integrated Prevention and Control of Industrial Pollution".

We will remind, June 20 Parliament passed based on the draft Law "On Integrated Prevention and Control of Industrial Pollution" No. 11355.

Later Ecopolitics wrote about "pitfalls" in the implementation of BAT, which experts indicated Associations of Environmental Professionals (PAEW). In their opinion, the incompetence of officials, the lack of appropriate equipment and the corruption risks inherent in the law on industrial pollution are capable of killing Ukrainian industry instead of modernizing it.
