The Ecocommittee supported the resumption of greenhouse gas monitoring and reporting

At its meeting on October 7, the Committee on Environmental Policy and Nature Management supported draft law No. 12131 on amendments to some legislative acts of Ukraine regarding the restoration of monitoring, reporting and verification of greenhouse gas emissions.

The notice about this appeared on the website of the committee.

The draft law was introduced by People's Deputy and head of the Eco Committee Oleg Bondarenko and other People's Deputies of Ukraine. It was developed to support the European integration course and implement the reforms defined by the Plan of Ukraine for the Ukraine Facility.

Based on the results of the review, the committee recommended that the Verkhovna Rada include this document in the agenda and adopt it as a basis.

In an explanatory note to the draft law, the lawmakers recalled that since the full-scale invasion during martial law, reporting within the MFA system has been made voluntary. They noted that the restoration of the mandatory system of monitoring, reporting and verification of emissions will ensure the collection of verified and transparent data and will allow moving to the next step regarding the creation of a system of trading quotas for greenhouse gas emissions (GHG) in Ukraine. According to the deputies, it is the most effective market mechanism for reducing greenhouse gas emissions.

Draft Law No. 12131 will not apply to installations that are not controlled, destroyed or located in temporarily occupied territory, or have officially announced the suspension of activity from the point of view of production.

What does the bill provide

  1. Introduction of mandatory submission of documents specified by the provisions of the Law of Ukraine "On Principles of Monitoring, Reporting and Verification of Greenhouse Gas Emissions" for operators who have not submitted documents since the introduction of martial law.
  2. Demarcation of operators into those whose installation was not damaged, suffered significant (completely destroyed) damage or minor (partially destroyed) damage, and detailing the obligation to submit documents defined by the provisions of the Law of Ukraine "On Principles of Monitoring, Reporting and Verification of Greenhouse Gas Emissions" , operators of such installations.
  3. Deduction of legal relations from monitoring, reporting and verification of greenhouse gas emissions from the scope of the Law of Ukraine "On protection of the interests of the subjects of reporting and other documents during the period of martial law or a state of war".

What European documents are implemented by the project of law No. 12131

The document supported by the Eco-Committee contains provisions that ensure approximation of the legislation of Ukraine to the following legislative acts of the EU:

  • Directive No. 2003/87/EU in the part concerning the MFA system;
  • Commission Regulation (EU) No. 600/2012 on verification of reports on greenhouse gas emissions and reports on ton-kilometers and accreditation of verifiers;
  • Commission Regulation (EU) No. 601/2012 on monitoring and reporting on greenhouse gas emissions.

Tasks that will help to implement the proposed draft law

According to the authors of the document, the adoption of this draft law will have a positive impact on the interests of the state and business entities and will allow:

  1. Restore the mandatory system of MIA that will meet international and European criteria and standards and ensure compliance of the calculation of greenhouse gas emissions with European standards regarding MIA.
  2. Get accurate and objective information on greenhouse gas emissions from installations subject to the draft law.
  3. Create conditions for the use of market mechanisms to help reduce greenhouse gas emissions.
  4. To ensure the fulfillment of Ukraine's obligations under the UKRAINE FACILITY and to create the prerequisites for the introduction of a system of trading quotas for greenhouse gas emissions in Ukraine.
