The Public Council appreciated the work of the Ministry of Environment

The Public Council recommended changing the approach to self-screening of the state of implementation of EU environmental legislation

Members of the Public Council of the Ministry of Environmental Protection and Natural Resources urged to involve their representatives in training working group Concepts of reform of the State Environmental Inspection.

The concept is planned to be submitted for consideration by the Ministry of Environment by October 25, Svitlana Berzina, head of the public council, announced the results of the meeting on Facebook.

She emphasized that Ukraine needs a reform of the State Inspectorate and the system of state control, the concept of which was developed back in 2016. However, the recently published document on the reform has been widely criticized by people's deputies, the public and experts.

Members of the public council emphasized the need to:

  • a public review of the analysis of the current Concept of the reform with an assessment of the state of its implementation, the reasons and consequences of non-implementation;
  • to involve in the preparation of the project of changes the experts of the Working Group on the development of legislative initiatives on the implementation of EU norms and recommendations in the field of environmental control, environmental damage and environmental liability under the Parliamentary Committee into Ukrainian legislation on issues of environmental policy and nature management, representatives of the State Inspectorate, public council and other organizations.

Berzina noted that the meeting also presented the results of the initial assessment (self-screening) of the state of implementation of the EU acquis, which was conducted by the Ministry of the Environment. Some of the necessary reforms have already begun.

"Primary analysis is only the first step. There is a lot of work ahead. The Public Council recommends applying a comprehensive approach through a deeper analysis of all reforms with the formation and determination of the sequence of adoption of legal acts, standards and management decisions so that each reform works effectively and is seen and appreciated by every Ukrainian," she said, adding that the Public Council is ready to continue work in this direction together with the Ministry of Environment.

Berzina said that the meeting also considered a legal conflict regarding the environmental impact assessment procedure for waste processing operations, namely transportation of recycled materials. Law No. 2320-IX "On waste management" provides a conclusion on environmental expertise or OVD for a number of operations that previously did not require environmental expertise.

" There is a question of the general expediency of the OVD procedure regarding this type of activity," she emphasized.

Members of the public council provided recommendations on changes to the criteria for determining planned activities and objects that are not subject to ATS. Work on the issue will continue.

In addition, the meeting determined the first steps to organize the Civil Society Institutes Project Competition "Sustainable Consumption – Better for You and the Environment" in 2023.

Earlier, EcoPolitic wrote, that the Ministry of Environmental Protection and Natural Resources created a working group that will conduct an initial assessment of the state of implementation of legal acts of the EU (EU acquis) in the direction of environmental protection. This will help determine at what stage Ukraine is currently in the implementation of European environmental legislation.
