The Tyachiv District Court seized land for the construction of small hydroelectric power plants (SHPPs) in the village of Kalyny in Zakarpattia due to the lack of environmental impact assessment conclusions and in the framework of criminal proceedings on the fact of forgery of documents for construction.

This was reported by Zakarpattya Online with reference to public human rights activist Vitaliy Gregor.

The court banned the developer, Hydroresurs-Teresva LLC, from using land plots with cadastral numbers 2124482800:01:002:0128, with an area of 12.6 hectares, and 2124482800:01:002:0129, with an area of 8.77 hectares, on the banks of the Teresva River, with the intended purpose of placing, constructing, operating and maintaining buildings and structures of energy generating facilities.

The investigating judge concluded that “the evidence provided by the pre-trial investigation body forms a sufficient set to apply a measure of restraint in the form of seizure of property in order to preserve material evidence, as well as to prevent further construction and maintenance of small hydroelectric power plants MHPP No. 1 and MHPP No. 2 in the absence of conclusions on environmental impact assessment”.

The arrest was made in the framework of criminal proceedings initiated at the request of a representative of the Save Kalyny initiative group on the fact of forgery of documents for the construction of a mini-hydroelectric power plant on the Teresva River. The court recognized the land plots as material evidence.

Also, in late April, Zakarpattya Online reported that during the illegal construction of a hydroelectric power plant on the Teresva River in Kalyny, workers damaged a flood control dam. This violation was recorded by the head of the Tyachiv Interdistrict Water Management Department, Serhiy Stoyka, who called the police.

EcoPolitic reported in early June 2024 that in the village of Kalyny, Dubove community in Tyachiv region, representatives of the local community at a hearing categorically opposed the construction of small hydropower plants on the Teresva river. And on July 1, it became known that the Ministry of Ecology had suspended consideration of the construction documents submitted by Hydroresurs-Teresva LLC to obtain conclusions on the environmental impact assessment of 2 channel mini-hydroelectric power plants on the Teresva.

In mid-April, we reported that, despite this, the construction of the hydropower plants had begun. Therefore, local residents gathered on the banks of the Teresva River and stopped the preparatory work before the construction of the mini-hydropower plant.
