In Kyiv, the National Anti-Corruption Bureau of Ukraine (NABU) and the Specialized Anti-Corruption Prosecutor's Office (SAP) have sent to court a case of illegal transfer of a part of the nature reserve fund of national importance in Nyvky Park for construction.
This was reported by the NABU press service on its official website.
What law enforcement authorities established
According to the investigation, in November 2019, the Director of the Department of Land Resources of the Kyiv City State Administration, who was the Deputy Head of the KCSA at the time of the crime, received a land management project for consideration, which de facto provided for the development of part of Nyvky Park. At the same time, in July 2019, the same project had already been submitted for consideration and was sent for revision, as the site belonged to the nature reserve fund.
However, the official ignored this fact and, using false information that the land plot did not belong to the nature reserve fund, submitted a draft decision to the Kyiv City Council to lease it to a private company for the construction of a residential and office complex.
As a result, the company leased 0.6 hectares of the park's land, and the Kyiv community lost the right to use this site. The amount of losses amounted to about UAH 6.4 million.
According to investigators, the following individuals have been served with suspicion notices:
- On November 2, 2023, the current Deputy Head of the KCSA, pursuant to Part 2 of Article 28 and Part 2 of Article 364 of the Criminal Code of Ukraine.
- On November 15, 2023, the former Head of the Examination Division of the Department of Land Resources of the KCSA was also served a notice of suspicion, as was the former head of the company that received the leased land.
They are charged with organizing and aiding and abetting the abuse of power under Article 27(5), Article 28(2) and Article 364(2) of the Criminal Code of Ukraine.
