On Tuesday, March 15, the Verkhovna Rada adopted as a basis and as a whole the draft law №7144 "On Environmental Activities and Civil Protection for the Period of Martial Law". It provides, in particular, for the simplification of the issuance of subsoil use licenses and the abolition of ATS for certain activities.

Goal: The draft law is designed to implement environmental measures, ensure the rights of economic entities in the field of subsoil use (except oil and gas), ensure the state's defense capabilities, and to regulate and simplify reconstruction work to eliminate the consequences of armed aggression and hostilities. martial law and in the reconstruction period after the end of hostilities.

The authors of the document note that there is an urgent need to simplify procedures and speed up reconstruction work to eliminate the consequences of armed aggression and hostilities during martial law and in the reconstruction period after the end of hostilities, in particular with regard to their inclusion in those that do not require environmental impact assessment.

In particular, the bill provides for:

  • amendments to Article 15 of the Law of Ukraine "On the legal regime of martial law "and to authorize the military administrations of settlements in the relevant territory issue permits for subsoil use (except for oil and gas) to ensure the state's defense capabilities for a period not exceeding one year;
  • amendments to Article 3 of the Law of Ukraine "On Environmental Impact Assessment", which provides that Reconstruction work to eliminate the consequences of armed aggression and hostilities is not subject to such assessment during martial law and in the reconstruction period after the end of hostilities;
  • suspension of the action of the fifth part of Article 39 of the Law of Ukraine "On Fauna", Articles 9-10 of the Subsoil Code of Ukraine until the termination or abolition of martial law in Ukraine.

According to the authors of the bill, its adoption will help ensure the state's defense capabilities during martial law, simplify permitting procedures, and regulate and accelerate the restoration of infrastructure and economy of Ukraine, return to normal life of Ukrainian citizens.
