In the near future, the State Environmental Inspection of Ukraine does not plan to resume business inspections in view of the requirements specified in the Cabinet of Ministers of Ukraine Resolution No. 303 "On Termination of State Supervision (Control) and State Market Supervision in Martial Law".
The State Environmental Inspection of Ukraine informed about this at the request of EcoPolitic.
The aforementioned resolution provides for the suspension of scheduled and unscheduled inspections of enterprises by the controlling bodies during the period of martial law introduced by the decree of the President of Ukraine.
Article 2 of this document provides for unscheduled measures of state control only in the presence of a threat that has a negative impact on the rights, legitimate interests, life and health of a person, protection of the natural environment and ensuring the security of the state. In such a case, unscheduled inspections are permitted based on the decisions of central executive bodies that ensure the formation of state policy in relevant areas – in the case of environmental inspections, it is the Ministry of Environmental Protection and Natural Resources of Ukraine.
Article 3 of the document states that if the threat originates from unscheduled inspections of business entities operating in the fields of energy and communal services are carried out by the decision of the National Commission that carries out state regulation in the fields of energy and communal services.
We will remind you that against the background of the gradual resumption of scheduled inspections of businesses by the tax inspectorate and the increase in the list of goods whose manufacturers are not exempt from scheduled inspections, rumors began to spread about the resumption of various types of scheduled inspections of enterprises.
Earlier, EcoPolitic reported that during inspections of chemical industry enterprises now will be held photo and video recording. This is provided for in the Procedure for Fixing Measures of State Supervision (Control) in the Field of Ensuring Chemical Safety and Management of Chemical Products, approved by the Cabinet of Ministers of Ukraine on October 14.
Also the government changed criteria for risk assessment from the activities of enterprises and the frequency of their inspections. The changes made to Resolution No. 383 of May 20, 2020 introduce a risk-oriented approach to inspections in the field of environmental protection.
In accordance with this document, planned measures of state supervision (control) are carried out by the State Inspectorate in relation to the economic entity classified as:
- high risk – no more than once every 2 years;
- medium risk – no more than once every 3 years;
- of a minor degree of risk – no more than once every 5 years.
