The possibility of submitting documents in paper form may be canceled

The Ministry of Environmental Protection and Natural Resources of Ukraine proposes to amend the Licensing Conditions for Hazardous Waste Management, including, among other things, replacing the possibility to submit documents in paper form with a personal application.

The draft resolution of the Cabinet of Ministers of Ukraine “Some Issues Regarding the Conduct of Economic Activities on Hazardous Waste Management”, which will enshrine the innovations, has been published for public discussion on its website.

Changes provided for by the resolution

  1. The terminology used in the License Terms should be brought into line with the Laws of Ukraine "On Licensing of Types of Economic Activity", "On Waste Management", "On Administrative Procedure". In particular, the term "cancellation" is proposed to be replaced by "termination".
  2. Exclude provisions on narrowing the type of economic activity in hazardous waste management.
  3. The possibility of submitting documents in paper form can be replaced by submission by personal application.
  4. Information on the availability of permit documents should be supplemented with a new item "Integrated environmental permit".

In the analysis of the regulatory impact of the draft resolution, the Ministry of Ecology noted that as of December 31, 2024, the register of licenses for hazardous waste management activities contains 38 licensees. It is assumed that all these business entities are subject to regulation.

According to the Ministry's calculations, the total costs of large and medium-sized businesses after the adoption of the resolution for the first year will amount to UAH 744, and the total costs of small businesses will be UAH 168 without additional costs in the future. In the first starting year, the cost of familiarization with the regulatory framework for one enterprise will amount to UAH 24, the agency calculated.

As EcoPolitic reported in mid-December, the Ministry of Environment responded to the collapse of hazardous waste in Ukraine. The ministry has developed a draft resolution of the Cabinet of Ministers, which provides for the extension of the validity of submitted declarations on waste treatment operations, including hazardous waste, until June 15, 2025.
