The Polish contractor Control Process S.A. systematically failed to fulfill the terms of the contract for the construction of a mechanical-biological treatment plant for solid municipal waste in Lviv. Due to the contractor’s refusal to perform certain works, its failure to allow other contractors access to the site, and other violations, the municipal enterprise “Green City” sent the contractor a notice of contract termination.

This was reported by the press service of the Lviv City Council.

All grounds for terminating the contract are documented and, according to municipal enterprise representatives, are substantial.

"Due to Control Process S.A.’s systematic failure to fulfill its obligations, as well as its failure to comply with the FIDIC engineer’s instructions and its lack of response to these comments, we have decided to terminate the agreement with this contractor," explained Oleksandr Yegorov, director of the municipal enterprise "Green City."

Unfulfilled conditions

The Lviv City Administration reported that the contractor received repeated requests to remedy the contract violations throughout 2025.

In particular, the contractor not only refused to hand over the project documentation to the customer but did not even complete its development. Additionally, the contractor failed to deliver part of the equipment purchased with funding from the Eastern Europe Energy Efficiency and Environment Partnership (E5P) Fund.

The Polish company also refused to carry out certain previously agreed works and blocked access for another contractor responsible for connecting the complex to the external power grid.

Following the notice of termination, the contract will come into force in 14 days. These conditions are stipulated in the agreement.

The administration promises to provide separate notification regarding when the Lviv solid waste processing plant will be completed and put into operation. EcoPolitic reminds readers that the plant’s construction deadlines have been continually postponed. In April 2023, the Mayor of Lviv Andriy Sadovyi announced that the waste processing complex would be completed by the end of the year. At the beginning of July that year, completion stood at 37.7%, and by August 2024 it had reached 65%.

By September 2024, construction was halted due to contractor violations; however, in November, new promises were made – to commission the plant and complete all commissioning work by August 30, 2025.
