This will make it possible to get rid of the practice of canceling or suspending a permit at the discretion of an official

The Committee of the Verkhovna Rada on environmental policy and environmental protection praised the draft law No. 9372 “On amendments to the Code of Administrative Courts, which regulate the procedure for annulling and granting special permits for the creation of nadras”.

The document cleans up the overregulation of the gallery and robs it of transparency, encourages the Ministry of Defense of Dovkill and Natural Resources from Facebook.

Significantly, that the Code of Administrative Judiciary should be supplemented with a new article 283-2. They will have a sign for them, for them:

  • The State Geology and Subsoil Service may apply to the court;
  • deadlines and requirements for filing a claim;
  • grounds for refusal to consider it;
  • deadlines for consideration and submission of appeals, etc.

Deputy Minister of Environmental Protection and Natural Resources Yevgeny Fedorenko explained that the draft law is necessary for the qualitative completion of the subsoil use reform in Ukraine.

"Law No. 2805-IX adopted in December [“On improving legislation in the field of subsoil use" – ed. ] it is determined that the annulment of the permit for the use of subsoil or the suspension of its validity in Ukraine on the grounds of arbitrary use of the subsoil and violation of the conditions of use determined by the special permit will be carried out exclusively by the court. In order for this rule to work, it is necessary to make appropriate changes to the Code of Administrative Procedure," he said.

According to him, this will make it possible to get rid of the practice of canceling or suspending a permit at the discretion of an official.

"So an honest business will receive additional guarantees for the protection of its rights, and the public will have the opportunity to monitor violators," Fedorenko added.

Earleir, EcoPolitic wrote, that in Ukraine, online issuance of special permits was launched in the electronic account of the subsurface user on the "EkoSystem" platform.

Previously, EcoPolitic analyzed, draft law No. 4187 "Regarding the improvement of legislation in the field of subsoil use", which launches the reform of subsoil use in Ukraine. In December, the Verkhovna Rada supported the document in the second reading.
