The economic court of the Kharkov region returned to the community of the Velikoburluk village council the rates and the land under it worth almost 650 million UAH, which the businessman illegally used.

The message about this was posted by the Kharkov regional prosecutor's office.

The investigation established that the entrepreneur since 2019 used a pond located on the beam of the Bolshoi Burluk River for artificial breeding, maintenance and cultivation of freshwater fish, as well as their catch. The mirror area of this water body is 36.5 hectares, the volume is 1055 thousand m3, and the area of the land on which the pond is located is more than 52 hectares.

The basis for the use of the pond was the "Mode of fishery exploitation of reservoirs" and permission for the special use of aquatic biological resources.

The Kupyan district prosecutor's office found that the entrepreneur did not have any legal documents and state registration of ownership or lease of the land plot on which this pond is located. Therefore, the prosecutors concluded that he was conducting economic activities contrary to the requirements of the current legislation.

Currently, the court's decision has actually been implemented – the lands of the water fund have been returned to the territorial community.

In June, EcoPolitic told that employees of the Kyiv Regional Prosecutor's Office through the court removed for illegal use of a plot of land of the forest fund with an area of ​​2.5 hectares and a value of almost UAH 50 million, on which the entrepreneur was engaged in fish breeding. They noted that land and forest legislation does not provide for the use of lands of the specified category for such purposes.
