The Ministry of Environmental Protection and Natural Resources of Ukraine has developed a procedure under which industrial enterprises that have an integrated environmental permit will transmit the results of automated real-time monitoring of their emissions to the Ministry and the State Environmental Inspectorate.
The draft resolution of the Cabinet of Ministers of Ukraine “On Approval of the Procedure for Transmitting the Results of Real-Time Emission Monitoring” was published on the official website.
The development and approval of such a procedure is provided for in Part 5 of Article 19 of the Law of Ukraine “On Integrated Industrial Pollution Prevention and Control”.
Who will be affected
The Procedure for Transferring the Results of Real-Time Emission Monitoring applies to the operators of installations:
- those who operate their facilities on the basis of integrated environmental permits, which provide for the requirements for the installation and operation of automated emission monitoring equipment;
- those who have installed monitoring equipment on their own initiative.
The operators of the facilities will be required to register, process and present the results of emission monitoring, land and groundwater pollution monitoring in such a way that the State Environmental Inspectorate can verify their accuracy and monitor compliance with the terms of the integrated environmental permit.
How the data will be transferred
To transfer the results of emission monitoring, plant operators will register their automated measurement systems and measuring equipment in the e-Environment functional module on the EcoSystem platform. It will store the following data:
1. Registration data of automated measurement systems:
- identification code according to the EDRPOU;
- name of the plant operator;
- name of the facility for which the automated measurement system is registered;
- integrated environmental permit number;
- registration status of the automated measurement system (registered, canceled, suspended);
- in case of cancellation/suspension of registration, the date of cancellation/suspension, as well as the reasons and grounds for such cancellation/suspension will be indicated;
- the serial number of the certificate or the qualified electronic signature certificate itself, which will be used to authorize the installation operator.
2. Registration data for the measuring equipment:
- registration data of the automated measurement system to which the measuring equipment belongs;
- date of registration of the measuring equipment;
- registration status of the measuring equipment (registered, canceled, suspended);
- in case of cancellation/suspension of registration of the measuring equipment, the date of cancellation/suspension, as well as the reasons and grounds for such cancellation/suspension will be indicated;
- data on annual verifications in accordance with the requirements of the legislation on metrology and metrological activities.
3. Data on the results of emissions monitoring.
In the future, the Ministry of Ecology should develop and approve the Instruction on the transfer of emission monitoring results obtained using automated measurement systems. It will define
- technical requirements for the registration of automated measurement systems and measuring equipment;
- requirements for the means and formats of transmission of emission monitoring results;
- the procedure for their processing by the EcoSystem.
The Procedure stipulates that after the registration of automated measurement systems and measuring equipment, the operator of the facility will test the possibility of transmitting the results of emission monitoring within 10 working days.
It is also noted that in the absence of communication between the automated measurement system and the EcoSystem, the operator of the facility must ensure the safety of the emission monitoring results and, within 24 hours after the connection is restored, transfer the emission monitoring results to the platform.
As a reminder, in March 2023, the Cabinet of Ministers approved the Procedure for the Implementation of Automated Emission Control Systems (AECS) under the Law “On Atmospheric Air Protection”. This Procedure stipulates that the installation of an ACS will be mandatory only for new equipment, and the requirement does not apply to existing facilities. Businesses will be able to install monitoring systems within 5 years after the termination or lifting of martial law in Ukraine.
