We have the next “crutches” that the department substitutes to prevent collapse in the field of waste management

The Ministry of Environmental Protection and Natural Resources of Ukraine proposes to allow business entities that have positive conclusions of the state environmental assessment or positive conclusions on environmental impact assessment to obtain a permit for waste treatment operations under a simplified procedure.

The draft resolution of the Cabinet of Ministers of Ukraine containing the relevant amendments to the legislation has been posted on its official website. The document is entitled “On Amendments to the Procedure for Implementing a Pilot Project on Simplified Procedure for Obtaining Permits for Waste Treatment Operations.”

If the government adopts these changes, the number of business entities that will be able to obtain a permit for waste treatment operations under a simplified procedure will increase significantly.

Who will be able to obtain permission to handle waste in a simplified procedure

Now this category includes business entities that perform waste operations According to the codes R1 – R13and According to the D15 codes, D15,If they have one of the following documents:

a) Positive conclusion of state environmental expertise on waste management:

  • hazardous (harvesting, transportation, sorting, storage, processing, processing, disposal, removal, disposal and disposal);
  • household (processing, processing, disposal, disposal and disposal);

b) Positive conclusion on environmental impact assessment, which determines the admissibility of conducting types of planned activities and waste management facilities:

  • operations in the field of hazardous waste management (storage, processing, processing, disposal, removal, disposal and disposal);
  • Operations in the field of household and other waste (treatment, processing, disposal, removal, disposal and disposal) with a volume of 100 tons per day or more;
  • installations for industrial disposal, removal of animal carcasses and/or livestock waste;
  • disposal, removal, treatment, disposal, disposal of household waste.

How to get permission in a lightweight order

The Resolution Project provides 2 options:

  1. Ecosystem registration, creation and filling in the account in the E-Corrend Module. The enterprises will then be able to keep records and report in the user's e -office.
  2. To obtain a permit for existing waste processing facilities whose activities have not undergone extensions and changes – submission of documents determined Waste on landfills.

The validity of the permissions received

It is worth noting that the permits for waste treatment operations under codes R1 – R13 and D1 – D15 will expire on September 1, 2025.

Until September 1, 2025, to obtain a license for hazardous waste management, business entities may submit positive conclusions of the state environmental impact assessment for waste management and positive conclusions on environmental impact assessment, which determine the permissibility of the planned activities and waste management facilities.

“The license for conducting hazardous waste management activities for these business entities shall be terminated on September 1, 2025,” the attached paragraph 111 to the Procedure states.

At the end of August 2024, the Cabinet of Ministers introduced a pilot project on a simplified procedure for obtaining a permit for waste treatment operations. It stipulates that enterprises that handle non-hazardous waste and whose activities have minimal impact on the environment can obtain a permit under a simplified procedure.
