How an enterprise can obtain an integrated environmental permit: the Ministry of Ecology told

The Ministry of Environmental Protection and Natural Resources of Ukraine has clarified the procedure for issuing integrated environmental permits (IEPs) for Ukrainian industrial enterprises in accordance with the requirements of the new Law No. 11355 ‘On Integrated Prevention and Control of Industrial Pollution’.

The agency has provided information on how to obtain a fundamentally new permit and how long it takes on its official website.

On 8 August 2025, the Law on Integrated Industrial Pollution Prevention and Control will come into force. It implements Chapters 1, 2 and 7 of Directive 2010/75/EU.

According to this document, companies will be required to obtain an integrated environmental permit for each of their installations that fall within the list of activities specified in the law.

The Ministry of Environment named the following steps of the enterprise on the way to obtaining an IDD:

  1. Determine the installation and whether it falls under the list of activities for which, according to the Law, it is necessary to obtain an integrated environmental permit.
  2. Submit to the Ministry of Environment an application for obtaining an IDD and all necessary documents.
  3. Wait up to 30 working days for the Ministry of Environment to conduct a preliminary review of this application. If necessary, the Ministry will provide additional clarifications. Based on the results of the review, the department either recognizes the application as acceptable, or informs about the need to eliminate deficiencies.
  4. If the application is accepted, publish an announcement about the start of public discussion.
  5. If deficiencies are identified, eliminate them within 30 working days and resubmit the application.
  6. After publishing the documents in the Register of Integrated Environmental Permits, hold a public discussion that will last 30 working days. During this period, the public will have the right to submit any comments and suggestions in writing or orally during public hearings. It is at this time that the state environmental inspectors will simultaneously conduct an inspection and survey of the installation and the industrial site. If necessary, cross-border consultations will also begin.
  7. After the completion of the public discussion, within 5 working days, receive their conclusions from the State Environmental Inspection and other competent bodies (State Water Agency, State Emergency Service, Ministry of Health, State Energy Efficiency, Regional State Administration/VCA). Other executive authorities and local self-government bodies may also submit their own proposals and comments to the operator's application.
  8. The final stage is the issuance of an IDD or a decision to refuse its issuance. 30 working days are set aside by the Law for this stage. Within this period, a coordination meeting with the participation of representatives of the Ministry of Environment, the installation operator, competent authorities, local self-government bodies and the public may be convened to consider the IDD project.

The validity period of the integrated environmental permit is unlimited. If the enterprise received an IDD for its installation, it has the right to put it into operation.

The Ministry of Environment also promised its advisory assistance to plant operators so that they could prepare all the necessary documents in a quality manner and avoid mistakes. The department noted that information on the issuance or refusal to issue an IDD will be public – it will be made public by both the Ministry of the Environment and the installation operator.
