The Ministry of Finance began to accept comments on the Rules for the technical operation of landfills

The Ministry of Environmental Protection and Natural Resources of Ukraine published a draft order "Rules for the technical operation of landfills, cessation of operation, reclamation and care of landfills after the cessation of their operation."

The corresponding message appeared on the website of the Ministry of Finance.

This document was developed in compliance with the requirements of Part 3 of Art. 40 of the Law of Ukraine "On Waste Management" for the implementation of uniform rules and standards for landfill management in the country.

The explanatory note to the order states that Ukraine has undertaken to implement the provisions of the Directive of the European Parliament and the Council No. 2008/98/EU of November 19, 2008 "On Waste and the Abolition of Certain Directives" into national legislation. Among these commitments is the introduction of a waste management hierarchy, where landfill disposal is the last way in the hierarchy to manage waste.

Specialists point out that at this time there are no clearly regulated and controlled organizational and technical requirements, measures and procedures that ensure the safe operation of landfills, prevent or reduce, as far as possible, the negative consequences of waste disposal for the natural environment.

The order establishes requirements for:

  • organizational and technical support for the operation of landfills;
  • criteria and procedures for accepting waste at landfills;
  • procedures for placement and storage of waste for the purpose of burying waste;
  • termination of landfill operation and reclamation;
  • further maintenance of landfills after termination of operation;
  • labor protection, fire safety, accident prevention;
  • control and monitoring during the life cycle of the landfill;
  • procedures for storing metallic mercury in landfills;
  • underground permanent storage of waste.

It is assumed that the implementation of the provisions of the new document:

  • will make it possible to prevent or reduce the negative impact of landfills on the natural environment and risks to human health;
  • will lead to a gradual reduction in the volume of waste buried in landfills, in particular those that are suitable for preparation for reuse, recycling and other waste recovery operations;
  • will improve the state of the natural environment;
  • will ensure a reduction in the use of natural resources;
  • will reduce the level of atmospheric air, water and land pollution due to the reduction of waste generation and disposal.

The ministry emphasized that this order, if approved, will enter into force from the day of its official publication, but not before the day of termination or cancellation of the legal regime of martial law in Ukraine.

The Department of Digital Transformation, Electronic Public Services and Waste Management of the Ministry of the Environment accepts comments and proposals for the draft order within a month from the day of its publication at the address: str. As Ecopolitic already reported, from August 29 to enterprises became easier obtain a permit for waste treatment. By their resolution, the authorities introduced a simplified procedure for obtaining permits for those of them who work with non-hazardous waste and whose activities have a minimal impact on the environment. In particular, a simplified procedure is provided for enterprises that bury waste at landfills.
