For some offenses, they will increase 25 times

The Ministry of Environmental Protection and Natural Resources of Ukraine has prepared a draft law that provides for a multiple increase in fines for offenses in the field of waste management.

What articles will be affected by the changes

In the draft Law of Ukraine “On Amendments to the Code of Ukraine on Administrative Offenses to Improve Liability for Waste Management Offenses,” the Ministry proposes to amend thirteen articles of the Code: 52, 59, 59-1, 72, 73, 82, 82-1, 82-3, 82-4, 82-5, 82-6, 82-8, 91-3. It is also envisaged to add new articles to the Code of Administrative Offenses:

  • Article 82-9 “Violation of the established procedure for submitting a waste declaration or failure to submit such a declaration”
  • Article 82-10 “Failure to take measures or inaction to eliminate unauthorized landfills”;
  • Article 82-11 “Failure to take measures to develop and/or approve a waste management plan”.

How will the amount of fines change and for which violations?

What penalties are provided for by the new articles of the Code of Administrative Offenses on Waste Management

According to Article 82-9, violation of the established procedure for submitting a waste declaration or failure to submit such a declaration entails a fine of UAH 850 to 1700 for officials and citizens – business entities.

Article 82-10 provides for a fine for local government officials for failure to take measures or inaction to eliminate unauthorized landfills, ranging from UAH 850 to UAH 1,700.

Pursuant to Article 82-11, officials of local governments, enterprises, institutions and organizations may be fined UAH 850 to UAH 1,700 for failure to develop and/or approve a waste management plan.

As a reminder, a month ago, the Ministry of Ecology published a draft law that strengthens criminal liability for offenses in the field of waste management.
