Successful implementation of the provisions of the framework law on the control of industrial pollution is possible only in the presence of professionally prepared by -laws

The Cabinet of Ministers of Ukraine has approved the Procedure for Conducting a Conciliation Meeting on the Issuance of an Integrated Environmental Permit.

The government's representative in the Verkhovna Rada, Taras Melnychuk, announced this on Telegram.

This document will come into force simultaneously with the Law of Ukraine No. 3855-IX “On Integrated Prevention and Control of Industrial Pollution” on August 8, 2025.

That determines the order

The approved document is prescribed:

  • the procedure for holding a coordination meeting on the issuance of integrated environment permit (amendments to it);
  • procedure of administrative proceedings for its recall;
  • Requirements for the form and content of the minutes of the coordination meeting.

The initiator of the convening of a coordination meeting, according to the Procedure, is the Ministry of Environmental Protection and Natural Resources of Ukraine. The two annexes to the order contain samples of the approval meeting protocols:

  • in the procedure for issuing integrated environment (making changes to it);
  • in administrative proceedings with the recall of integrated environment.

For what purpose is the coordination meeting going to

  1. To reconcile the position of competent authorities to issue an integrated environment (amendment to it) and its conditions.
  2. To consider the issue of retreat in accordance with Article 13 of the Law on Integrated Prevention and Control of Industrial Pollution.
  3. At the request of the installation operator, submitted before the term of consideration of the application for an integrated environment (amending it) by the competent authorities.
  4. To determine the conditions of integrated environment, if the activity or type of production process used in the installation is not included in any conclusions of the best available technologies and management methods or if such conclusions do not apply to all potential impacts of activity or production process on the environment.
  5. If necessary, to take into account the results of cross -border consultations when issuing an integrated environment (amending it) or when deciding to refuse it (amendments to it).
  6. At the request of the installation operator, submitted within 10 working days from the date of publication of the decision on the start of administrative proceedings for the withdrawal of integrated environment.
  7. If necessary, on your own initiative.

The format and course of holding the meeting

According to the text of the Procedure published in the draft, the Ministry of Ecology may decide to hold a coordination meeting via video conference. The meeting is chaired by a representative of the Ministry. If the operator of the facility fails to appear, the coordination meeting is held in his absence. The decisions made at the coordination meeting are documented in a protocol.

The Procedure obliges the Ministry of Ecology to publish the minutes of the conciliation meeting through the Unified State Register of Integrated Environmental Permits no later than 3 business days after the date of its holding.

The Ministry of Environment published a draft resolution of the Cabinet of Ministers “On Approval of the Procedure for Conducting a Conciliation Meeting in the Procedure for Issuing an Integrated Environmental Permit (Amendments to it) and in Administrative Proceedings for its Revocation, Requirements for the Form and Content of the Minutes of the Conciliation Meeting” on September 18, 2024.
